Welcome to mtgbuilder.ai ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the mtgbuilder.ai website and all related services (the "Service"). By accessing, browsing, or using mtgbuilder.ai, you ("user" or "you") agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

1. Introduction

By using mtgbuilder.ai, you agree to comply with and be legally bound by these Terms of Service. If you do not accept all of these Terms, you are not authorized to use mtgbuilder.ai.

2. Description of Service

mtgbuilder.ai provides an intelligent card search assistant for Magic: The Gathering (MTG), with a primary focus on the Commander format.

The Service uses artificial intelligence and semantic search to allow users to find cards using natural language queries.

Access to the Service is managed via a credit-based system. We reserve the right to modify features, search capabilities, or the credit economy at any time.

3. User Accounts and Payments

To use the Service, you must sign in with your Google account using Google OAuth authentication. You are responsible for maintaining the security of your account and for all activity that occurs under it.

3.1 Credits and Usage

The Service operates on a credit system. New accounts are provided with an initial credit pool. Actions such as sending messages or performing search queries consume credits.

3.2 Purchases

Users may purchase additional credit top-ups through our third-party payment processor, Stripe. All purchases are final and non-refundable unless otherwise required by law. We reserve the right to change credit pricing or the "cost" per action at our discretion.

4. Privacy and Data Usage

Your privacy is important to us. Personal data and usage information are managed according to our Privacy Policy.

4.1 Data Collection and Logging

By using the Service, you acknowledge that all conversations and search queries are logged via PostHog to assist in debugging AI workflows and improving application quality. During the current beta phase, please be aware that data logging is not yet anonymized.

4.2 Use of Google Data

Information from your Google account is used solely for authentication purposes via Google OAuth. We do not use this data for advertising or sell it to third parties.

5. Third-Party Services

mtgbuilder.ai utilizes third-party services essential for functionality:

  • Vercel: Hosting of the web application.
  • Supabase: Database management and authentication; securely stores user data, conversation histories, and payment metadata.
  • Stripe: Handles all payment processing and billing.
  • PostHog: Collects analytics and full conversation logs for service improvement and debugging.
  • Scryfall: Provides the underlying Magic: The Gathering card database, imagery, and price data.
  • Gemini: We use large language models provided by Gemini to process your natural language queries and generate card recommendations.

Each provider has its own legal policies which may apply to your use of the Service.

6. Disclaimer of Warranties and AI Output

THE SERVICE AND ALL DATA PROVIDED THROUGH MTGBUILDER.AI ARE OFFERED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND.

6.1 AI-Generated Recommendations

While we strive for accuracy, AI can produce "hallucinations" or incorrect technical interpretations of Magic: The Gathering rules and jargon. You are responsible for verifying card text, legality, and synergies before purchasing physical cards or entering tournaments.

7.2 Card Data Attribution

Card prices and other card data are provided by Scryfall. Scryfall makes no guarantee about its price information and recommends you see stores for final prices and details.

7.3 Service Content

Excluding the MTG assets mentioned above, the website design, code, and AI workflows are the intellectual property of mtgbuilder.ai and its owner.

8. Acceptable Use

By using mtgbuilder.ai, you agree not to:

  • Attempt to "jailbreak" or manipulate the AI models to generate content outside the intended use of the Service (as defined per section 2 “Description of Service”).
  • Use automated scripts, spiders, or scrapers to harvest data or cards from the Service.
  • Resell the Service's outputs or provide them as a commercial API without a written agreement.
  • Abuse the credit system or attempt to circumvent payment requirements.

9. Limitation of Liability

To the fullest extent permitted by law, mtgbuilder.ai and its owner will not be liable for any damages arising out of your use of the Service. This includes, but is not limited to:

  • Financial loss from card purchases based on AI suggestions.
  • Errors in card price data or format legality.
  • Loss of chat history or stored credits.
  • Interruptions in service due to third-party API failures (Scryfall, Gemini, etc.).

10. Changes to Terms or Service

We reserve the right to update these Terms at any time. We may also change, suspend, or discontinue features—including the pricing of credits—without notice. Continued use of the Service signifies your acceptance of any modified Terms.

11. Termination

You may stop using mtgbuilder.ai at any time. We reserve the right to suspend or terminate your access (and void any remaining credits) without notice if we believe you have violated these Terms, engaged in automated abuse, or acted in a way harmful to the Service or other users.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. Any legal actions or disputes shall be subject to the exclusive jurisdiction of the courts located in France.
